You can, actually, pirate a mod, but its not the mod author*s) who have any copyright claim, it is the creator of the work you are deriving from. Ie, in that case, Bethesda.

As the creator of a derivative work, you have basically no rights under copyright law. You would have to be able to claim your work has some original portion (a model for instance), in which case only that original portion you could stake a claim to (if it didnt heavily use existing trade dress) or be able to claim the work is a transformative enough product bot to be considered derivative (not happening with a mod)
