      Update on Trademark Action (Fraud Claim Dismissed, New Filing)

      As per our commitment to transparency, here's a brief update on the trademark action we have discussed previously.On Thursday, the Trademark Trial and Appeals Board (TTAB) dismissed SFLC's claim of fraud against Conservancy, as we predicted.This sensible ruling is just the next step of many; the suit will proceed at the usual near-glacial pace of litigation. On Friday, we moved to the next procedural step, which is to ask the TTAB to allow us to update our answer as planned.

      @clacke I still think FOSS funders (individuals and organizations) should defund SFLC until they purge themselves of this idea and the people who backed it.

          Quick update on Trademark Matter

          We've promised transparency, and we're committed to it even when the news is annoying for us. If this proceeding weren't such a waste of time and resources, I might even be fascinated by the twists and turns that are inherent in litigation and are often new to me as a non-lawyer.The current primary issue is that SFLC has sought to amend their initial petition with the TTAB to add a claim on fraud. Their claim is that Software Freedom Conservancy shouldn't have been allowed to register our trademark because we were aware of the SFLC trademark registration. As Karen and I stated briefly before, these claims are baseless.

            SFLC: Escalation Disguised as “Settlement Offer”
            from Software Freedom Conservancy
            Conservancy stands by our motion for summary judgment to dismiss Software Freedom Law Center (SFLC)'s petition to cancel our trademark. This remains the most resource-efficient way to dispense with SFLC's unwarranted attacks. We have received their latest escalation, disguised as a “peaceful settlement” offer. Instead of deescalating today, SFLC added inflammatory accusations against Conservancy and its employees. Obviously, we did not commit fraud; our legal counsel, Pam Chestek, has advised us that SFLC's fraud allegation is “unequivocally unfounded”. We will not let them further waste our time.
