Transgenderism should not belong to the ideological left, which organizes itself around collectivism and conformity to identity groups. Claiming a non-standard gender, the defining characteristic of a non-binary identity, is itself an expression of individualism. It rejects conformity to a gender identity group.

After a hundred years, can we please retire the disingenuous "fire in a crowded theater" line as an appeal-to-authority argument for censoring free speech?

There are two types of people who use swear words. The first type use swearing without thought. It's just how people speak where they came from, and it's no big deal.

The second type uses swearing to deliberately shock. To them, it is a form of emotional warfare. This tactic requires that swearing be unusual and taboo amongst the audience, and it is highly effective on people who have been indoctrinated by society into constantly policing their own thoughts.

If the court can write the laws, who needs a legislature?

The rationale behind the Identity movement (and its associated political ideology) is predicated on the axiom that one can assign to a person an identity group, and then then infer about the individual characteristics and behaviors of the group which were not part of the original categorization criteria.

This kind of assumption has a name. It is called Faulty Generalization, or more commonly, Stereotyping. It is a logical fallacy.
